GENERAL TERMS: This website is operated by AB Driving School. By visiting, using our website and or purchasing from us, you agree to be bound by the following terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of our services. We reserve the right to refuse service to anyone for any reason at any time. You have 30 days to complete the driver’s education course online.
PARENTAL CONSENT REQUIRED FOR MINORS: If you are a minor under the age of 18 you may not enroll until your parent or legal guardian has reviewed and accepted these terms and condition. If you do not live in California, are under the age of 15, and or do not have parental consent you are not permitted to register for our course.
CHANGES TO SERVICE, COURSE & TERMS AND CONDITIONS: We reserve the right to change, update, replace, suspend, cancel or discontinue our online course and any part of these terms and conditions by posting updates or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. You can review the most current version of the terms and conditions of service at any time at this page.
ONLINE SERVICES “AS IS”: our course is approved by DMV and fulfills the teen driver’s education requirement for the Sate of California. We do not warrant the quality of our course or information will meet your expectations, or that any errors in the service will be corrected. We are not responsible if information on this site is not accurate, complete or current. In addition to taking drivers education online student shall read the California handbook.
MAINTENANCE: Online course may be unavailable during system maintenance or in an emergency. You agree that from time to time we may remove our services, course or website for indefinite periods of time without notice to you and you agree not hold us responsible. There will be no refund.
PAYMENT AND BILLING: You agree to provide current, complete and accurate purchase and account information for all purchases made online. If a charge, which is deemed valid by us, and validated by our terms and condition of service, is disputed to a financial institution by performing a charge-back, then the client agrees to pay an Administrative Fee of $40 in addition to original amount of funds, which were reclaimed.
THIRD-PARTY LINKS: This website may have links that direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of those websites. Please refer to third parties policies.
PROHIBITED USES: You are only allowed to use this website to take the online drivers education course to get your drivers education certificate. Any other use is unauthorized and you can be held liable. You are prohibited from using this website, its content and our services: 1) to reproduce, duplicate, copy, sell, resell or exploit any portion of our website or course; 2) redistribute, broadcast or transfer information; 3) to submit false or misleading information about our course to defame or slander; 4) to interfere with or evade the security features of our course and website; 5) to upload or transmit worms, viruses or any other malicious code that will or may be used in any way to destroy or affect the functionality or operation of our website and course; 6) to collect or track the personal information of others; 7) to spam, phish, pharm, pretext, spider, crawl, or scrape; 8) for any unlawful purpose and to violate any federal or state regulations, rules, laws, or local ordinances; 9) to infringe upon or violate intellectual property rights. 10) to record agents conversations without written permission.
LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES AND INDEMNIFICATION: We do not warrant or guarantee that our website and course will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of our course will be accurate or reliable. This website, course and services are as is with all faults and as available for your use, without any representation, warranties or conditions of any kind, either express or implied including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, and non-infringement. You expressly agree that your use of, or inability to use, the service is at your sole risk. Use of our services and courses does not eliminate the risk of, and does not guarantee against, a data security event of any other unauthorized breach or data compromise. In any event of unauthorized breach or data compromise you agree to hold us harmless. In no case shall AB Driving School, our employees, agents or contractors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of our website, course or service. You agree to indemnify, defend and hold us and our employees, agents and contractors harmless from any claim or demand, including reasonable attorneys fees due to or arising out of your breach of these terms or violation of any law or the rights of a third-party.
SEVERABILITY: In the event that any provision of these terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
CHOICE OF LAW & VENUE; WAIVER OF JURY TRIAL: This agreement will be governed by and construed in accordance with the laws of the state of California. The exclusive venue for any action or claims under this agreement shall be in the Courts of San Bernardino California. You irrevocably and unconditionally agree and submit to the jurisdiction of San Bernardino California Courts and waive any objection to the venue of such courts whether based on inconvenience of forum or any other grounds. You agree to waive any and all right that you may have to a trial by jury in any judicial proceedings relating to or arising under this agreement, services and course.
TERMINATION: Violation and breach of any of these terms and conditions of service will result in an immediate termination of our course. If in our sole judgment you fail, or we suspect that you have failed, to comply with any terms and conditions we will deactivate, destroy or delete your password, account, and terminate this agreement at any time without notice. We will bar any further access to our online course. Furthermore, you acknowledge and agree that we shall not be liable to you or any third-party for any termination of your password, account or the online course. All other provisions in these terms and conditions of service shall survive termination.
DRIVERS CERTIFICATE, SHIPPING TERMS & DISCLAIMER: Certificate deliveries are processed by regular US Mail Monday through Friday, during normal business hours, excluding holidays. You should receive your certificate in approximately 10-15 days. All delivery times are estimates only. We do not ship outside of California. Once a certificate leaves our location, we cannot guarantee the delivery or delivery time frame as it is out of our control. We are not responsible for any delays due to weather, shipping providers, delivery carrier factors, non-delivery, customer error, holiday related delays, lost mail or any other unforeseen factors. If a certificate is lost or damaged during shipping, a replacement, including cost and shipping will be sent to you at your expense and request. You will not be entitled to refund. If you prefer to pick up the certificate at our location please call (909) 881-3232 for an appointment immediately after you enroll into our course otherwise your certificate will be mailed.
REFUND POLICY: No school enrollment fee refunds or returns will be issued for any reason at any time. No refund for failure to pass quizzes, final exam or any DMV Written test. There is no refund if certificate is lost in the mail or damaged.
PRIVACY POLICY: Our privacy policy may be found from a link at the bottom of our home page. By accepting these terms and conditions, you agree that you have read it, understand it and agree to the privacy policy.
